澳洲儼然已成為背包客的天堂，在憎多粥少的情況下，

找到黑工的機會比遇上小強的機率還大。

做黑工不但薪水比別人少，還要提心吊膽深怕薪資沒入袋，

善良的包友們碰到這種惡質老闆，往往只能忍氣吞聲、自認倒楣。

其實澳洲政府有提供檢舉管道，

申訴一個壞老闆不只為自己討公道，

也是為後人尋求福利。

在此分享親身體驗，希望有遇上相同情形的包友們，也可以為自己出一口氣阿！

要離職去雪梨跨年，提前三周告知老闆，

得到的結果竟是扣薪水480元，

管他離下班還有兩小時，直接走人，

『靠~~老娘不幹了!!』

申訴步驟

STEP 1（搜證）：

簽約書、工作時數、薪水條、和雇主的通訊內容…，

像我都是領現金沒有薪水條，

所以每天一定要寫下自己的上下班時間，

每周自己算薪資是否和雇主給的數目符合，

最後統整成表格也可以成為證據之一。

即使是黑工只要有證據，正義還是會站你這邊的。

STEP 2（警告）：

這是尋求法律途徑前的最後通牒，

寫一封信給惡質雇主，具體描述積欠的薪水、申訴的事件，

任何有利的相關證據可以一併附上，

要求七天內解決，不然就等著被查吧！！

以下是通知信的範文

I am writing about a concern I have in relation to certain employee entitlements.

on a _______ (full-time or part-time or casual 填入正職或是兼職) basis as a _______ (job title 填入職稱).

I understand that my employment is subject to _______.

(name of award, agreement or legislation

填入相關法律或條文，像我在餐廳打工就是Fast Food Industry Award)

Under this Award, I believe __________________.

(list your complaint here including details of monies owed 列出具體事項，包含雇主欠多少錢)

I would appreciate your consideration of my complaint. If I do not hear from you within 7 days,

I will consider approaching the Fair Work Ombudsman to assist in resolving this matter, which may result in a full investigation.

You may wish to seek independent legal advice on this matter.

If you require further information in relation to your obligations under the Award you can contact the Fair Work lnfoline on 13 13 94

 建議從郵局寄信給雇主，保存收據，

 此信件需要兩封，一封寄給雇主，另一封存底做為申訴的證據。

 以免雇主賴帳說你從來沒寄過通知信。

老闆就打電話來，請我把錢領走，

也許是欺善怕惡，也許是怕進入Step 3，

會把辛苦經營起來的事業搞垮，所以投降了！！
